Case Digest: Monica M. Pontiano, Rosalyn M. Matandag, Elsie R. Balingasa, Criselda J. Espinoza, Miguel R. Pangilinan, Marlon A. Villa, and Louie T. Dela Cruz v. Atty. Fabian A. Gappi A.C. No. 13118, June 28, 2022 Supreme Court, En Banc Ponente: Justice Ricardo R. Rosario

 

FACTS

The complainants engaged the legal services of Atty. Fabian A. Gappi to represent them in a labor case. They alleged that after accepting the engagement and receiving attorney's fees, respondent failed to diligently handle their case. He repeatedly failed to attend scheduled hearings, neglected to take the necessary legal steps to protect his clients' interests, and did not keep them informed of the status of their case. His negligence eventually resulted in the dismissal of their complaint.

When confronted by his clients regarding the dismissal of the case, respondent allegedly concealed the true status of the proceedings and falsely represented that the case was still pending. He even assured the complainants that he was taking the necessary legal actions despite knowing that their case had already been dismissed. The complainants eventually discovered the truth on their own and thereafter filed an administrative complaint against him before the Integrated Bar of the Philippines (IBP).

During the proceedings before the IBP, respondent failed to comply with several lawful orders directing him to file his answer and participate in the investigation. His repeated disregard of the directives of the Commission on Bar Discipline delayed the resolution of the administrative case. The IBP found that respondent violated several provisions of the Code of Professional Responsibility (CPR) and recommended the imposition of disciplinary sanctions. The case was thereafter elevated to the Supreme Court for final action.

ISSUE

Whether or not Atty. Fabian A. Gappi was administratively liable for neglecting the legal matter entrusted to him and for failing to competently and diligently represent his clients in violation of the Code of Professional Responsibility.

Whether or not respondent's misrepresentation regarding the status of the case and his failure to promptly inform his clients of its dismissal constituted dishonest and unethical conduct in violation of Rule 1.01 of Canon 1 of the Code of Professional Responsibility.

Whether or not respondent's repeated failure to comply with the lawful directives of the Integrated Bar of the Philippines–Commission on Bar Discipline warranted the imposition of an additional administrative fine.

HELD

The Supreme Court found Atty. Fabian A. Gappi GUILTY of violating Rule 1.01 of Canon 1, Canon 11, and Rule 18.03 of Canon 18 of the Code of Professional Responsibility. The Court held that respondent neglected the legal matter entrusted to him by failing to appear at scheduled hearings and by failing to exercise the competence, diligence, and devotion expected of every lawyer. Rule 18.03 of Canon 18 requires a lawyer not to neglect a legal matter entrusted to him, as such negligence renders the lawyer liable for disciplinary action. Likewise, Rule 1.01 of Canon 1 prohibits lawyers from engaging in unlawful, dishonest, immoral, or deceitful conduct. Respondent violated these duties by misleading his clients regarding the true status of their case.

The Court emphasized that the practice of law is a privilege burdened with conditions. Lawyers owe their clients fidelity, competence, and candor. Respondent's failure to inform his clients that their case had already been dismissed, coupled with his false assurances that the case remained pending, constituted dishonest conduct that eroded the trust and confidence essential to the attorney-client relationship. The Court further stressed that negligence causing prejudice to a client's cause is a serious breach of professional responsibility.

The Court likewise held that respondent violated Canon 11 of the Code of Professional Responsibility by repeatedly ignoring the lawful directives of the IBP-Commission on Bar Discipline. Lawyers are duty-bound to observe respect for the courts and quasi-judicial bodies and to assist in the speedy and efficient administration of justice. Respondent's refusal to comply with the IBP's orders unnecessarily delayed the disciplinary proceedings and demonstrated disrespect for the disciplinary authority vested in the IBP and the Supreme Court. For this reason, the Court imposed a separate fine of ₱15,000.00 for his non-compliance.

Accordingly, the Supreme Court SUSPENDED Atty. Fabian A. Gappi from the practice of law for three (3) years, effective upon receipt of the Decision, and WARNED that a repetition of the same or similar acts would be dealt with more severely. He was likewise ordered to pay a fine of ₱15,000.00 for failing to comply with the directives of the IBP-Commission on Bar Discipline. The Court directed that copies of the Decision be furnished to the Office of the Bar Confidant, the Integrated Bar of the Philippines, and the Office of the Court Administrator for appropriate recording and dissemination.
